When a woman finds out sheā€™s pregnant, she is filled with excitement, worry, joyā€”and sometimes fear. For women at this critical crossroad, I pledge to again make Minnesota a state that offers real alternatives. Minnesotaā€™s court decisions in Gomez (1995) and Gilligan (2022) ruled that a constitutional right to abortion exists in Minnesota. The 2023 passage of the PRO Act codified that right, overturning decades of pro-life legislation in Minnesota. This means currently, no legislator can remove a woman's access to abortion in our state. But there is plenty we can and must do to encourage our communities to support each pregnant woman in crisis who doesnā€™t want her crisis to end in abortion. We must simultaneously support womenā€™s health and value the gift of life.

Judicial & Legislative Roadmap

The following court decisions and statutes have defined the access to abortion in Minnesota

1973 - Roe v. Wade - U.S. Supreme Court decision. The Court ruled that the Constitution of the United States generally protected a right to have an abortion.

1995 - Doe v. Gomez Minnesota Supreme Court decision. This decision ruled that the Minnesota Constitution guarantees the right of privacy to choose between childbirth and abortion. During Roe v Wade, this ruling added additional legal protection for access to abortion in Minnesota.

2022 - Dobbs v. Jackson Womenā€™s Health Organization - US Supreme Court decision. This decision returned to the federal and state legislatures the power to regulate any aspect of abortion not protected by federal statutory law.

2022 - The Gilligan Decision, State District Judge Thomas Gilligan of Ramsey County Ruling. Judge Gilliganā€™s ruling concluded that existing Minnesota abortion laws relating to mandated physician care, hospitalization, criminalization, parental notification, and informed consent are unconstitutional.

2023 - Minnesotaā€™s Protect Reproductive Options Act - Minnesota Statue. Governor Walz signed into law this act to "explicitly protect and codify abortion rights" within Minnesota law.
